LOCAL | City of Germantown Sued By Resident For Receiving A Citation For Her Holiday Decorations

A woman has federally sued the City of Germantown, arguing that the removal of her skeleton Christmas decorations violated her First and Fourth Amendment rights.

Last October, Alexis Luttrell decorated a skeleton and a skeleton dog for Halloween and placed them in her yard. Her intentions were to leave them in her yard for several holidays moving forward.

She was cited in December for violating a Germantown city code with the decorations. Residents are not allowed to decorate their homes for holidays or other special occasions more than 45 days prior to or 30 days following the planned celebration, according to the code.

According to the lawsuit, Germantown’s Holiday Decorations Ordinance is illegal since it dictates how residents celebrate holidays.

Luttrell wants the city’s holiday legislation to be completely repealed and the court to rule that Germantown violated her rights under the First and Fourteenth Amendments.
