Dr. Omar Hamada says the language of Tennessee House Bill 883 needs modified to protect the integrity of the original trigger law that took effect following the ruling in the Dobbs case. The amendment that is currently in committee and being supported by Mark White and others, could open the door towards leniency and allow doctors to perform abortions based on “good faith judgements”.

1)  A physician’s “good faith medical judgement” needs to be changed to a physician’s “reasonable medical judgement”. The way it’s written leaves open a huge door as the state can’t prove subjective bad faith. We need an objective standard against which to measure.
2) Abortion is allowed to “prevent or treat a (potential/possible) medical emergency”. “Prevent” needs to be removed as there is no reason to abort based on something that does not yet or may never exist.
Those are the two primary issues that could open the barn door wide.
